OPINION: Death Penalty: In the end, you support it too

I'm an awful human being. I judge people. I even go further: I make judgments in my head about whether someone should live or die. What gives me the right to do that? Well, making judgments in a heartbeat has kept me alive so far. When I started thinking about writing a column about the death penalty, I was tempted to take the easy, funny way out. You know: Dane Cook groupies, people who wear fur, and racists should all be killed. Then I decided to stick to the facts.

For me, facts are very personal. Take these numbers into consideration: Texas, which is the largest state in the contiguous United States, has about 24.7 million residents and had about 1,300 murders in 2008. Meanwhile, Puerto Rico, where I come from, is 100 miles long by 35 miles wide, has 3.9 million residents and had about 850 murders in 2008. That's 65 percent of the murders with barely 15 percent on the population. So, what does Texas have that Puerto Rico doesn't? You got it: the death penalty.

This is the part where all the anti-death penalty folks jump out and scream that the death penalty is not a deterrent. Unfortunately for those folks, academic investigations proving that beyond the shadow of a doubt are as numerous as the articles and studies demonstrating exactly the opposite. In other words, researchers are still trying to figure out whether the death penalty has a deterrent effect.

The problem with all that research is that academics seek to generalize their findings to the larger population, when the only undeniable truth in all this mess is that every brain is a universe. For me, if the death penalty keeps one wacko from taking a shotgun to someone's chest, mission accomplished.

Let me take on the religious folks next. Bible-thumpers are the first to defend killers and rapists while condemning everyone else. I'll use their own favored tool: the Bible.

Sure, Romans 12:19 says, "Never take your own revenge, beloved, but leave room for the wrath of God, for it is written, 'Vengeance is mine, I will repay,' says the Lord." I, for one, tend to find God's absolute lack of immediate action a tad exasperating. When a guy rapes and kills a five year old, hand me the gun, syringe or knife: I'll gladly expedite his trip to deal with his God. Furthermore, Numbers 35:17 states: "If he struck him down with a stone in the hand, by which he will die, and as a result he died, he is a murderer; the murderer shall surely be put to death." I'm not a religious man, but those are holy words I can get on board with. You killed a baby? All right, you deserve to die.

On to the incorrigible humanists. I'm a strong supporter of Human Rights. Hell, if you've read this column more than once, you already know I always write defending the rights of every conceivable minority and I'm always flipping the proverbial bird at the establishment. That said, an individual who puts a lot of premeditation and a healthy dose of malice into ending an innocent human life is not a human that deserves protection.

Last but not least, everyone else. Say it: "Innocent people have ended up on death row!" You're right: we need to tighten up the law. We need to re-open all cases of death row inmates that were sentenced to death before DNA testing and we need to re-open cases in which evidence was lost. Most of the exonerated inmates from the past few years were convicted before DNA testing: they all deserve a second chance.

Also, we need to take some crimes off the death-penalty list. I would take treason, espionage, resisting arrest, arson, robbery and kidnapping out of the list of crimes punishable by the death penalty, as long as they didn't result in the death of innocent victims. That said, all cases dealing with the murder and/or rape of minors, murder during the commission of sexual assault, aggravated assault and murder with aggravating factors (i.e. murder committed to escape arrest, the victim was younger than 6 years of age, murder was willful, deliberate and premeditated, etc.) should remain on the list.

With tighter laws and more control, I think most other opposition to the death penalty falls short when some monster takes a life. Ultimately, it's not about vengeance or justice: it's about eradicating a dangerous and costly problem in an effective way.

Mi bandera tiene el fondo negro, un par de tibias cruzadas y una sonriente calavera. Para mí, el negro de fondo significa, como para los piratas del siglo XVII, la muerte.

En mi caso, me refiero a la anhelada muerte de la estupidez impune frente a la carcajada traviesa. Cada mañana, justo antes de leer la prensa, me toco el pecho mientras izo mi pícara calavera en contra de patrióticas gestas carentes de sentido, trillados discursos políticos e incoherentes pasiones ideológicas desprovistas de análisis. Con la risa como escudo, se puede lidiar mejor con el machismo, la memez, la farándula y otras extravagancias incomprensibles.

Ejemplo: el representante popular Jaime Perelló llamó pecosa a la bandera de Estados Unidos y el representante novoprogresista David Bonilla explotó en típica reacción bravucona de gallo de pelea.

Señores: las banderas no le dan de comer a nadie. Morir por una bandera es una tontería, al igual que insultarla. La bandera de Estados Unidos merece respeto, pero también hay que acordarse de que el país que la ondea ha cometido crímenes de guerra en sitios tan diversos como Panamá, Somalia e Irak. ¡La hilaridad reside en la enardecida ignorancia de ambos!

¿De qué nos sirven los políticos insulsos que con tanto fervor se abrazan a sencillos eslóganes yermos? ¡De nada!

Lo que necesitamos es humor pirata: que Rivera Schatz culpe a alguien de conducta indecorosa es tan hilarante como un asesino en serie leyendo en voz alta la Declaración Universal de Derechos Humanos.

Que Acevedo Vilá diga que Luis Fortuño es el peor gobernador en la historia moderna de Puerto Rico demuestra que jamás ha leído un libro de historia: ¡por lo menos debería usar la palabra empate!

Que Ricky Martin piense que ser homosexual es una carrera per se es casi tan jocoso como que publicó un libro.

¿Ven? Lo único que hace falta es un poco de humor.

Ríe, iza tu bandera pirata y recita con Mafalda: “Amo a la Humanidad, lo que me revienta es la gente”.

La migra

Esta semana le tocó a la migra. Mi vecino de columna en UWeekly se dedicó a sembrar pánico: los inmigrantes ilegales te van a robar la indentidad. Por mi parte, opté por destacar algunos datos que pocas personas conocen.

The U.S. Immigration and Customs Enforcement, also known as la migra, is the largest investigative agency in the Department of Homeland Security. They're in charge of enforcing a wide array of laws, including those intended to keep our borders secure and free of drug smuggling.

In order to make sure the border stays safe, ICE has joined forces with other federal, state and local law enforcement institutions to create the Border Enforcement Security Task Force (BEST). (It says a lot that they chose to leave the F out of their too-good acronym. I guess BESTF doesn't pack the same punch.)

Our nation's attention, thanks in great part to the way our media manages the issue, has been focused on our southern border. All we hear is that drugs are coming into the U.S. - no one tells you that the stuff comes here simply because it's a great market. We also hear that the border has experienced a dramatic surge in cross-border crime and an increase in violence in recent years, due to the antics and battles between uber-dangerous Mexican drug cartels and other, usually unnamed, dope smuggling organizations.

All this "southern drug fiends" "discourse" grants bigots the opportunity to claim that undocumented immigrants are bad for this country and bring nothing but criminal activity. The arguments are easy to swallow when you see la migra cracking down on shady-looking immigrants while wearing their full ass-whooping, freedom-protecting regalia. Unfortunately, ICE has done little to mitigate the negative effects of their actions; they have never stated the fact that the percentage of immigrants involved in trafficking is very small. You would have to visit their webpage to know that only 5,200 criminal arrests have been made since BEST was created. In any case, at least they're honest, and their job is commendable: they try hard to keep the drugs and the criminals out. But what about the ICE?

ICE has remained quiet about a series of facts that would put in jeopardy the blind support they receive from many Americans. According to the Immigration Policy Center, immigrant unemployment rates are lower than the national average in the U.S. That means that immigrants have regular jobs and contribute to the economy. It also means that most immigrant families have a positive net fiscal impact on the U.S., annually adding "$88,000 more in tax revenues than they consume in services," according to an IPC report. The same report claims that Social Security payroll taxes paid by "improperly identified" (that means "undocumented") workers "have led to a $463 billion funding surplus." Not bad, huh?

Okay, so the immigrants are not sucking all the money out of the U.S. and sending it back home, but they are a burden on our welfare system, right? Wrong. Immigrants are far from being the welfare queens that restrictionists would have you believe.

Let's go back to the IPC report's title, Giving Facts a Fighting Chance: Answers to the Toughest Immigration Questions. "The truth is that unauthorized immigrants are not eligible for most public benefits, and even legal immigrants are limited in what they can receive," says the reports. "Most legal immigrants cannot receive federal Medicaid, Temporary Assistance to Needy Families (TANF), Supplemental Security Income (SSI), or food stamps during their first five years or longer in the United States - regardless of how long they have worked or how much they have paid in taxes. Even when they are eligible for certain programs, experts say that low-income immigrants are less likely to receive public benefits than are U.S. citizens."

Get the point yet? La migra and the media have you believing that immigration equals drugs and crime. The truth is another thing. Federal efforts to "clean" the country are far removed from real solutions that embrace openness. Our imaginary and physical walls achieve nothing constructive, and simultaneously undermine potential for cultural and financial growth. The ICE needs to keep their business close to the border and the "immigration is bad" discourse needs to give facts a chance to force the open, historically contextualized immigration reform that we so badly require.

El libro de Ricky Martin...¿o pensaron que me iba a quedar callado?

Hoy me hierve la sangre: tenemos libro de Ricky Martin, disco del imbécil de Ricardo Arjona, los animales puertorriqueños siguen abusando de sus crías y Deepak Chopra y Pablo Conejo, pilares de la literatura universal, felicitan a Ricky Martin por finalmente aceptar su homosexualidad. Como defensa intelectual, y por aquello de exorcizar los demonios que navegan por mis negras venas, he optado por deconstruir una de las tantas notas que estos días inundan el periódico: otra estupidez sobre el bodrio de libro de Ricky Martin. La nota es de Damaris Hernández y apareció en endi.com hoy, martes 2 de noviembre. Vamos al mambo.

Si usted pensaba que adquirir hoy el esperado libro "Yo" del astro boricua Ricky Martin sería un dolor de cabeza por largas filas, se equivocó.
El panorama es todo lo contrario.


Por un segundo esto me hizo pensar que el país había desarrollado un cerebro. En Puerto Rico, país conocido por el arroz con culo que se forma por cualquier estupidez y donde la incompetencia hace de cualquier evento uno plagado de largas filas y humores caldeados, que no haya fila para comprar el libro sólo puede significar una cosa: ni la madre de Ricky está comprando la mierda de libro. Sigamos.

Esta mañana el flujo de público que se dio cita a la tienda Borders de Plaza Las Américas para adquirir el libro era moderado.

Moderado es una palabra fina para decir nulo.

La mayoría llegó desde antes que la tienda abriera sus puertas a las 9:00 am, sin embargo, la cifra de admiradores que madrugó fue de alrededor de 30 personas, según informó el gerente de mercadeo de Borders Héctor Torres.

Aparte de la pésima redacción, el precedente párrafo denota la falta de apoyo masivo: 30 gatos es nada. Más de 30 almas se puede encontrar en cualquier fast food del área metro a la hora del almuerzo cualquier día de la semana.

"Ha venido toda clase de público, desde estudiantes hasta profesionales antes de llegar a sus trabajos. Tenemos un volumen alto de libros en español e inglés. Todo el mundo lo va poder adquirir", aseguró Torres.

Traducción: “Por favor, vengan y compren esta mierda porque si no nos vamos a meter por el culo las trescientas cajas de copias que tenemos en el almacén.” Que conste que no sería la primera vez que Borders pone en el suelo de la tienda cientos de copias de alguna basura que no vende como esperaban. Si a Borders le importara algo la humanidad, utilizarían esos libros de más para construir casas para los pobres.

Durante el recorrido de El Nuevo Día se observó a varios clientes que fueron en busca del libro, que fue lanzado hoy mundialmente. En su mayoría, feminas y personas de la comunidad gay.

¡No jodas! ¿De verdad? ¡Wow, qué sorpresa! ¿Quién se iba a imaginar que el libro de Ricky Martin lo comprarían gorditas analfabestias y maricones empedernidos? Me sorprende esa demografía: yo me imaginaba una sarta de hombres varoniles, músicos serios y mujeres intelectuales, feministas radicales, por poner un ejemplo, comprando el panfletito de marras. Oh, otra cosa: Srta. Hernández, féminas lleva acento.

A media tarde, Torres indicó que el ritmo de ventas seguía "al mismo paso". Sin embargo, indicó que el mismo "es un buen ritmo".

Traducción: “En un país donde no se lee, vender cincuenta copias de cualquier libro que no sea de fotos es un logro.”

"Aparte del libro del caso del niño Lorenzo es el libro que mejor se está moviendo".

Asco. Acabo de vomitar un poquito.

El flujo en las tiendas de Escorial y Mayagüez también es "bueno y proporcional" al de la de Plaza Las Américas, que por su volumen, indicó Torres, es cuatro veces mayor al de aquellas.

No me voy a meter con la redacción. En resumen: aquí vendimos unas cien copias y allá vendieron unas veinticinco.

"Quería el libro porque más que admirarlo como cantante, lo respeto como ser humano. Quiero saber qué quiere contar de su vida y de su faceta como padre", mencionó Lilly Martínez.

Yo también respeto a cualquier homosexual que niega su identidad para proteger su carrera, intenta mentirle a sus fanáticos (no muy bien, por cierto) y ahora saca un libro para seguir haciendo dinero.

En ambas entradas de la tienda se ubican dos exhibidores con la publicación del artista, la cual describe como la mejor producción de su vida

Srta. Hernández, o quien sea el encargado de poner los textos en la página: el hecho de ser una página web no le da a usted derecho alguno de comerse los puntos al final de las oraciones cuando le venga en gana. Segundo: el hecho de que el libro sea lo mejor dice mucho de todo lo que le precedió.

Asimismo el gerente añadió que tiene un gran inventario de libros para el In store del 13 de noviembre, donde la estrella, que decidió revelar su homosexualidad al mundo, firmará los primeros 300 ejemplares.

Si el 13 de noviembre algún loco decide liarse a tiros en el Borders de Plaza, no seré yo quien se oponga. Para aquellos queridos lectores que adquirieron ya su copia de las interesantísimas revelaciones del Sr. Martin, les deseo desde lo más hondo de mi ácido corazón que se les pudran los ojos mientras leen esa soberana mierda.
